Terms of Service

Welcome to Wafflr (“the App”). By accessing or using the App and its services (“Services”), you agree to these Terms of Service (“Terms”). These Terms incorporate a strict policy on objectionable content and user abuse. If you do not agree, you may not use the Services.
1. Eligibility & Acceptance
1.1 Age Requirement: You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services. If you are under the legal age of majority, you must have parental or guardian consent to use the App.
1.2 Agreement to EULA: For iOS users, these Terms incorporate the Apple Licensed Application End User License Agreement (“EULA”) to the extent applicable. For Android users, you agree to comply with Google Play’s Terms of Service. In the event of any conflict between these Terms and a third-party app store’s terms, these Terms will control.
1.3 Zero Tolerance: Wafflr enforces a strict policy against objectionable content or abusive behavior, as detailed in Section 2.4. You acknowledge that we may remove offending content and/or eject the responsible user within twenty-four (24) hours of receiving a valid report.
2. User Conduct & Objectionable Content
2.1 Prohibited Conduct: You agree not to post, transmit, or share content that:
- is unlawful, harmful, threatening, harassing, defamatory, obscene, or hateful;
- violates any applicable local, state, national, or international law;
- infringes upon the rights of others, including intellectual property and privacy rights;
- is deceptive or fraudulent, including impersonating others;
- attempts to hack, disrupt, or otherwise misuse the App or Services.
2.2 Reporting Mechanism: If you encounter objectionable or abusive content, you can flag or report it within the App (e.g., via “Report” on a video or user profile). We will review all valid reports promptly.
2.3 Blocking Users: You have the option to block any user you deem abusive or inappropriate. Once blocked, that user is restricted from interacting with your profile or content.
2.4 Removal of Offenders: We will respond to valid reports within twenty-four (24) hours by removing or restricting offending content and/or ejecting the user who posted it, if we determine such content or behavior violates these Terms.
3. User-Generated Content & License
3.1 Ownership: You retain all rights to any content you create or share through the App.
3.2 License to Wafflr: By posting or transmitting content through the Services, you grant Wafflr a non-exclusive, worldwide, royalty-free license to display and distribute your content for the sole purpose of providing the Services, subject to the limitations of our Privacy Policy.
3.3 No Responsibility for Third-Party Use: We do not control how other users may interact with your content (e.g., screenshots or re-shares). You assume all risks associated with posting or sharing any personal or sensitive information publicly.
3.4 Content Removal: We reserve the right, but have no obligation, to remove or disable any user-generated content that violates these Terms or our policies.
4. Account Responsibility
You are responsible for protecting your account credentials and for any activity under your account. If you suspect unauthorized activity, promptly notify us at support@wafflr.app.
5. In-App Purchases & Subscriptions
Certain features may be paid or subscription-based. All purchases are processed via your respective app store account:
- Subscription fees auto-renew unless canceled at least 24 hours before the current period ends.
- You can manage or cancel your subscription through your app store account settings.
6. Privacy & Data Collection
Our data practices are explained in our Privacy Policy (incorporated herein by reference). By using the Services, you acknowledge and consent to our collection, use, and sharing of your information as outlined in the Privacy Policy.
7. Third-Party Services
The App may integrate or link to third-party platforms or services. We are not responsible for the content, policies, or actions of any third-party website or service. Your interactions with these third parties are governed by their own terms.
8. Modifications to the Services
We may update, modify, or discontinue parts of the Services at any time, with or without prior notice. We are not liable to you or any third party for any resulting changes or discontinuation.
9. Termination
We may suspend or terminate your access to the Services if you breach these Terms or engage in conduct that, in our sole discretion, is harmful to the App, other users, or third parties.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WAFFLR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAFFLR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL WAFFLR’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE PAST TWELVE MONTHS.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in California, United States, to resolve any disputes arising under these Terms.
13. App Store Requirements
If you downloaded the App from the Apple App Store, you acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms. You also agree to comply with all applicable Apple terms and conditions.
If you downloaded the App from the Google Play Store, you agree to comply with all applicable Google Play terms of service.
14. Changes to These Terms
We reserve the right to update these Terms. When we do, we will revise the “Last Updated” date at the top of this document. Your continued use of the Services after we make changes indicates your acceptance of the revised Terms.
